Thing is the US military is unique in the fact that under our UMCJ, each soldier is required to evaluate the orders that they are give. Under 5 standards, do they comply with the UMCJ, do they comply with the GENEVA Convention & do they comply with the constitution of the United States, to they comply with military morals & do they comply with the overall mission & image of the military?
As a Veteran of US Army 93-07 I've ran into this issue many times. During Iraq I witnessed many of my fellow soldiers go to prison, for following orders & standing rules of engagement, because of media political pressures.
Since Vietnam the rules of being a soldier are no longer set in stone, here's your mission get it done & try to limit collateral damages. To now we even have to think about how did we kill the enemy. While civilian law enforcement hid behind & enjoy that protections of qualified immunity, since 2003 military no longer are afforded it.
So while a soldier can't just disregard orders & refuse them out right, they also aren't allowed to blindly comply with them. It's a damned if you do damned if you don't.
