I hate to say it, but Fauci gets away at the end of this movie.

Many folks are upset about Biden preemptively pardoning St. Anthony of Fauci. I’m not and for two reasons, 1) I fully expected Biden to do it (that is why the 8,000 pardons, Biden just wanted you to know it was just a humanitarian act he did in the midst of a flood of humanitarian acts) and 2) Fauci will never be held to account unless it is in the court of public opinion.

There is a thing in US law called the "business decision defense", it means that a legitimate defense is that the business simply made a bad decision that led to some negative event and proving that the failure wasn’t just a result of a bad decision is a tough hill to climb. I know, I was just involved in a four-year legal fight as one of two plaintiffs in a breach of contract and false inducement case. By contract, we had to go to arbitration – and there is no appeal in arbitration. The arbitrator seemingly ignored our evidence of malice aforethought on the part of the Board of Directors, and said, "Well, I can see how they could have just made a bad decision" and called the case a draw - no award or legal expenses awarded to either party.

Look, Fauci isn't stupid, he will claim something similar - and will not be found culpable.

Our legal system is simply insufficient to capture crimes like this. That is why there must be something bigger.

That’s why I think the two options left are a Nuremberg type situation or simply a massive public investigation with him as the star witness that leads to a massive public shaming and convictions of a bunch of non-pardoned co-conspirators.

Because he unleashed this on the world, I would prefer a Nuremberg type investigation and trial (if warranted) to be held for Fauci and the people who engaged in this gain of function work, including the Chinese actors – and let it get away from them.

The Nuremberg trials were established under the London Charter of the International Military Tribunal (IMT), signed on August 8, 1945, by the Allied powers (United States, United Kingdom, Soviet Union, and France). The charter defined the legal framework for the trials, covering charges of crimes against peace, war crimes, and crimes against humanity it also provided a legal basis for prosecuting Nazi leaders and laid out procedural rules. It got its legitimacy from the international agreement between the victors and several other international treaties and agreements.

I don’t expect it to happen. We would never get enough cooperation from the world’s nations to do get it off the ground – and without a significant number of countries engaged there won’t be the legitimacy needed to pass sentence. There are too many Europeans mesmerized by “science” that supports their totalitarian impulses, too many countries that just hate America, and too many with a Chinese leash attached to their necks, to do it.

That leaves only the public shaming angle.

I would drag his arrogant, wormy little “I am science” ass back to testify in front of God, Rand Paul, and Congress about his involvement and the involvement of others in the creation of the Covid fiasco and its aftermath and take it from there. I don’t think he can legally refuse and fresh perjury under oath before Congress is not covered under the pardon, since it is a new crime committed after the period covered by the pardon. I would hammer him until he is found so radioactive, nobody will touch him without a Geiger counter nearby, maybe even find a way to claw some of those sweet Big Pharma royalties back.

At any rate, it is going to take a big set of cajónes to get this done, and while I think there are several who fit that bill in government today, I just don’t think there are enough of them.
