Justice Free Zones
Progressivism is the death of fairness and the equal application of the law.
Are there justice free zones in America today – places where a fair trial is practically impossible?
I think the evidence says that there are, especially if you are a Christian, a conservative Republican or a former president named Donald J. Trump.
Jonathan Turley makes the argument that the judge in the Trump "falsification of business records” case, Judge Juan Merchan, really should recuse himself due to the fact he has presided over two cases involving Trumpworld and has inside information that could influence his decision on the current case.
And on top of that:
The judge's family is clearly supportive of Democrat positions, his daughter worked for Kamala Harris' campaign and now flacks for other Democrat candidates.
Alvin Bragg bragged that he had been part of over 100 lawsuits against Trump and his companies and his wife tweeted that her husband was focused on bringing Trump down.
Letitia James, the state AG and another person who ran on the "Get Trump" platform, has been investigating Trump and his companies, filing what qualifies as nuisance lawsuits for 6 or 7 years.
The federal prosecutors in the Southern District of New York have been engaged in finding dirt on Trump since the beginning of Crossfire Hurricane back in 2015/2016.
If Judge Merchan refuses to recuse and if he can't see his way to dismissing a case with zero basis, he should grant a change of venue from an area where the judge himself is an elected partisan, the prosecutor who was elected due to his promise to "get Trump", and a jury pool consists of 84.5% of a population that voted against Trump in 2020, to somewhere less politically charged.
In a fair world, even with these cards stacked against President Trump, the people still have the power to objectively reason guilt or innocence – or to reason that the charges are baseless based on the law and the evidence.
Can the people of Manhattan do that?
Coming from such a logic free, emotionally reasoning jury pool, I think the obvious answer is a resounding and emphatic “Hell no”.
Forget the corrupt nature of the progressive, Soros funded prosecutorial systems in Democrat controlled cities, they are only part of the issue. The people who form the juries in these areas are the real problem.
I would wager to say that there might be a couple of homeless people in Manhattan who have not heard every word about this case and given the nature of the multitudes of witch hunts aimed at anything with the Trump name on it, it is just as likely the 84.5% of Manhattanites would be biased to convict simply because Orange Man Bad and as the remaining 14.5% would acquit given the unfairness of this case, regardless of the evidence.
The political pressure in Manhattan is so intense to “get Trump”, my bet is an outright dismissal “on the papers” is possible (but not very likely) but a change of venue is out of the question. The leftist Manhattanites want blood, and they want it from Trump.
But the problem is not just exclusive to the $24 of island land surrounding Central Park.
We just saw a man convicted of murder - in Texas of all places – for protecting himself. U.S. Army sergeant Daniel Perry fatally shot a “protester” at BLM demonstration in 2020, the “protester” in question was approaching Sergeant Perry while pointing the business end of an AK-47 at him. Perry had a side gig driving an Uber and during the “protest” in downtown Austin, his car was swarmed by a crowd such that Perry assumed a defensive position. Given the chaos around him, when Sgt. Perry saw Garrett Foster approaching with the weapon, he deemed it as a threat.
A Travis County grand jury returned a murder indictment against him.
Austin and Travis County are heavily Democrat and they lead Texas in insane progressivism. This is the county that spawned Ronnie Earle, the first local DA to use lawfare to take down a high-profile Republican, Texan Tom Delay, who was the Majority Leader of the US Senate at the time. Delay was acquitted on appeal several years later, but the damage was already done. His time as Majority leader was done, as was his political career.
Then there is the case of the Arizona rancher, George Kelly, who shot and killed an illegal alien crossing his property after being constantly faced with illegals threatening him, his wife and property for the past two years. The Democrat chief deputy attorney for Santa Cruz County in the border city of Nogales, Kimberly Hunley, made the assertion that rancher Kelly began shooting at the group “out of nowhere” on Jan. 30 without issuing a warning or a request to leave, something that Kelly denies.
Several illegals corroborated Hunley’s filing, enough so that two counts of aggravated assault “using a rifle, a deadly weapon or dangerous instrument” were added.
I’m sure illegal aliens have absolutely no reason to lie and are far more trustworthy than a 73-year-old rancher just trying to protect he and his wife and their property in the complete absence of a federal government doing its job to protect our border. The man he killed, identified as Gabriel Cuen-Butimea, was convicted of illegal entry and deported back to Mexico several times, most recently in 2016.
Santa Cruz County went for Biden in 2020 in a margin of 67.2% to 32.8%.
How much of a chance do you suppose Kelly has?
About as much as a J6 protestor charged and tried in Washington, D.C. (that went 92.1% to 5.4% for Biden over Trump in 2020).
Let’s not kid ourselves. In these jurisdictions, the fates of Sgt. Perry, George Kelly – and Donald J. Trump – were sealed the minute they were charged.
There is a reason this process is repeated in Democrat strongholds – it is because the people in these areas are so thoroughly politicized, there is no objectivity. They trust their left leaning government officials to such a degree, in their minds, your guilt is established immediately when you are charged. They are just there to validate that decision.
To have a public so ideologically indoctrinated that they can't reason their anal orifice from a hole in the ground is one thing when it comes to public debate, but when it comes to our system of jurisprudence and the adversarial/jury system upon which it rests, it is another thing entirely.
The call is coming from inside our house.
Amerika has become a "justice free zone". While most still deny it, the USA has become the modern Babylon. Although his book is nearly 20 years old, Robert Bork's SLOUCHING TOWARD GOMORRAH is still important reading and it is important to know what has happened to America and what the ultimate outcome will be. #GoPutin
