High Tech Lynching - Part II
The liberal left are out to hang Justice Thomas, and take down the Supreme Court in the process.
Mother Jones’ David Corn, had this to say about Justice Clarence Thomas:
“Does anyone believe that the color of his skin was not a factor in GHW Bush’s appointment of Clarence Thomas to fill the seat vacated by Thurgood Marshall? He benefitted from this affirmative action and accepted the nomination. Then he killed affirmative action for others.”
The insufferable racist, Michael Eric Dyson, tweeted:
“This is the face of a man who climbed the ladder of affirmative action to his present perch of power only to help destroy the very ladder on which he ascended. This is not only the mark of deep ingratitude & disavowal of history, but a withering betrayal of justice & democracy.”
If anything, Justice Thomas is the victim of a process in which he had nothing to say.
Affirmative Action was the law of the land by the time Justice Thomas was entering college and he literally had no option if he was to accept admission to either Holy Cross or Yale Law. This was a policy put in place by liberal politicians and kept there by liberal justices with help from cowardly Republicans.
This is nothing more than the same argument the liberal left uses in the case of taxes.
The “rich” don’t pay their fair share even though they pay what is legally required. They use loopholes in the law because Congress put them there. When they perform this completely legal behaviors, the left screams that they are immoral because they don’t choose to pay more than is required – even if none of the rich liberals, many in government, don’t rush to write the IRS an extra check when they pay their taxes (if they pay them).
The rich taxpayers are merely playing by the rules of the game they had no say in creating.
Same goes for any black student.
Race based affirmative action has been the policy of the United States federal government since JFK signed Executive Order No. 10925 on March 6, 1961, which included a provision that government contractors "take affirmative action to ensure that applicants are employed, and employees are treated [fairly] during employment, without regard to their race, creed, color, or national origin". In 1965, President Lyndon B. Johnson issued Executive Order 11246 which required government employers to "hire without regard to race, religion and national origin" and "take affirmative action to ensure that applicants are employed and that employees are treated during employment, without regard to their race, color, religion, sex or national origin.”
Clarence Thomas was 13 years old when President Kennedy signed the first EO mandating affirmative action in federal contracting.
Over time such requirements became codified into law by Congress and state governments.
In 1997, Barbara Grutter, a white resident of Michigan, applied for admission to the University of Michigan Law School. Grutter applied with a 3.8 undergraduate GPA and an LSAT score of 161. She was denied admission while lesser qualified black students were accepted. In 2003, Grutter v. Bollinger reached the Supreme Court.
Thanks to twisted and cowardly reasoning in which Sandra Day O’Connor, nominated by Ronald Reagan, became the swing vote in a 5-4 decision, siding with the liberal wing of the Court (Stevens, Breyer, Ginsberg, Souter) to allow race-based selectins to continue. Voting against continuing it were Justices Rehnquist, Scalia, Kennedy, and Clarence Thomas.
In a strong minority dissent, Justice Rehnquist (joined by Scalia, Kennedy, and Thomas) wrote:
“The Court, in an unprecedented display of deference under our strict scrutiny analysis, upholds the Law School's program despite its obvious flaws. We have said that when it comes to the use of race, the connection between the ends and the means used to attain them must be precise. But here the flaw is deeper than that; it is not merely a question of "fit" between ends and means. Here the means actually used are forbidden by the Equal Protection Clause of the Constitution.”
There is nothing inconsistent in Justice Thomas’ consideration in the cases of Grutter v. Bollinger in 2003 or the case of Harvard and UNC twenty years later.
Since its inception, Affirmative Action has been unconstitutional. It was in 1997, in 2003 and until a majority firmly grounded in Constitutional scholarship finally ended the scam on June 30, 2023.
And the liberals can’t deal.
The liberal left is, charitably described, a collection of miserable douchebags.
They are the racists, out to personally destroy Clarence Thomas for being a black traditionalist jurist. They have also adopted the perspective regarding the Supreme Court, that if they can’t have it, no one can.
It is just another attempt at a high-tech lynching.
