Biden and the Four Elements of Fraud
Why shouldn't the GOP have a little lawfare fun?
Having recently been involved in litigation of fraud (as a plaintiff), I have learned that in civil litigation, allegations of fraud might be based on a misrepresentation of fact that was either intentional or negligent.
That got me thinking about Thursday night’s Dem-debacle and its aftermath.
I began to think how the civil fraud statutes might apply to the Biden campaign and its lying enablers.
You and I know that the Democrats' statements about Biden, especially those within the last few months have been intentional. They must have been. Scarborough, Tribe, any of these loons on MSNBC and CNN claiming that Biden is “sharp as a tack” behind closed doors had to know - and they had to know they were lying to the public.
I have learned there are four basic elements for a statement (or statements, plural) to constitute intentional fraud:
The person who made it must either have known the statement was false or been reckless as to its truth.
The speaker must have also intended that the person to whom the statement was made would rely on it.
The hearer must then have reasonably relied on the promise, and
There must be damage because of the misrepresentation and reliance upon it – either financial damage or some other harm to the victim.
Well, most certainly the statements made by the politicos and journos that Biden's brains had not turned to cold oatmeal meet the first three, and anyone who has donated time or money to the Biden campaign might be able to claim the last one.
It might be certified as a class action because there are so many people who could show harm.
I’m no lawyer, nor have I recently stayed at a Holiday Inn Express, but I would think a reasonable case could be made against MSNBC and CNN – or their individual contributors – and maybe even the DNC itself.
Look, this makes as much sense than the cases pursued by E. Jean Carroll, Letita James, Alvin Bragg or Jack Smith – maybe even more.
Might not be able to sue Biden and his cabinet if he is in office, but thanks to the Democrats’ zeal to sue one certain ex-president, there is a precedent for doing it when his term is over – which, in this case, looks to be around January of 2025.
I must believe there are going to be enough pissed off donors and maybe a bunch of independents who will have contributed and then thrown their votes away in reliance of the claims that Biden is “just fine.”
This whole thing has been a long con, from the 2020 basement campaign to June 27th, 2024, and going forward has been all about hiding the truth from the American people.
It is a stutter, they said. He has a cold, they said. Thirty-year-old staffers can’t keep up with him, Peppermint Patty said. He is “cogent” and “the best Biden ever,” Joe Scarborough said - just two weeks ago. “He’s doing calculus, designing spacecraft for Elon Musk, and deriving the meaning of life in his sleep,” the Democrat faithful were led to believe.
Then they find out on live television and in front of millions (including undecided voters) that Scooby Do mysteries are too much for him to solve.
They realize Scranton Joey can’t mentally process fast enough to put together a recognizable sentence and he “beat Medicare”, the Border Patrol Union endorsed him (they didn’t – and tweeted so minutes after the claim), women are getting pregnant by their sisters, and no military died under his watch (a very big lie, considering the thirteen soldier who needlessly perished at Abbey Gate during Biden’s retreat from Afghanistan).
There have been a tiny few - like David Axelrod, Snakehead Carville, Bill Maher, and Minnesota Democrat Congressman Dean Phillips - who have been pulling the fire alarm to stop the parade as if they were the soon-to-be ex-Congressman Jamaal Bowman.
They are insulated.
But the rest of the Democrats and their co-dependent enablers are not.



Amen.
Win or lose in November, I hope Trump takes ALL these folks to court.
If he wins, I'm now at the point I would love to see him appoint a group to prosecute all the journalists and former officials for their verified bad acts. Obama would be a good catch but I'd like to see Brennan, Holder, and Hillary first up in the batting line up.
